The Gambling Act 2005
Under the Gambling Act 2005 licensing authorities will be responsible for issuing various permissions, permits and notices relating to the use of premises for gambling activities within their local areas.
Background information
The Gambling Act 2005 has three clear objectives:
- Keeping gambling crime free
- Making sure that gambling is fair and open
- Protecting children and vulnerable adults
Unlike the Licensing Act, the Gambling Act does not include the prevention of public nuisance as an objective. There is however other relevant legislation that deals with public nuisance.
Permissions, permits and notices
Licensing authorities will undertake inspections and enforce the conditions on these issued licences, permits and notices. They will also register small scale society lotteries.
Any objections to new premises or requests for review should be based on the licensing objectives of the Gambling Act.

- Betting offices and race tracks
- Bingo clubs
- Adult gaming centres
- Family entertainment centre
Permits
- Gaming machines in alcohol-licensed premises, such as pubs
- Gaming machines for members clubs
- Gaming in members clubs
- Unlicensed family entertainment centres (Category D machines only - i.e. those that have the lowest level of stakes and prizes)
- Prize gaming

Register of premises
Section 156 of the Act requires licensing authorities to maintain a register of the premises licences it has issued. The register is available to view at the Council Offices, The Campus, Welwyn Garden City during opening hours and copies of entries may be requested.
