Successful prosecution against noise nuisance

Welwyn Hatfield Borough Council is pleased to announce that at court on Monday 30 July it successfully prosecuted a resident for causing nuisance and distress by playing loud amplified music.
At St. Albans Magistrates Court, Lisa Ward, of 50 Longmead, Hatfield, was given an 18 month conditional discharge and instructed to pay the council £558.09* for breaching a noise abatement notice served under section 80 of the Environmental Protection Act.
Environmental health officers served the noise abatement notice on Miss Ward on 12 January 2007 following complaints of noise nuisance and evidence collected through the installation of noise monitoring equipment. Despite the notice being served, Miss Ward continued to play loud music, and on 22 January 2007 a breach of the requirements of the notice was witnessed by one of the environmental health team.
Subsequent to her breaching the notice council officers confiscated televisions and stereo equipment from Miss Ward’s property and started legal proceedings.
