Demotion Orders
The Council can apply for a Demotion Order if a tenant behaves in an anti-social manner or allows members of their household or visitors to do so.
What is a Demotion Order?
A Demotion Order ends a secure Council tenancy and replaces it with a demoted form. This means that the tenant loses certain rights, such as the right to buy their home and their right to mutually exchange. In addition, we will not normally allow a tenant to transfer if their tenancy is subject to a Demotion Order.
The demotion period is 12 months. If at the end of that the Council is satisfied that the tenant's conduct has been satisfactory the tenancy will be made secure again. However, if during the 12 months the tenant breaches their tenancy agreement further by acting anti-socially the Council will serve a Notice to Quit. This ends the tenancy and the tenant is likely to be evicted.
