Community Infrastructure Levy (CIL) Forms and Guidance

We will acknowledge all documents received in writing. Development should not begin until written acknowledgement has been received.

Please note: proof of delivery lies with the liable party.

Form 1: CIL Additional Information Form

Applicants for planning permission must submit the CIL Additional Information Form (see above) alongside their planning application. This allows our CIL team to assess whether the proposed development is liable for the Community Infrastructure Levy (CIL).

When completing the CIL Additional Information Form, please refer to the Additional Information Form Guidance (see above) to ensure accuracy.

Depending on your development's CIL liability and the stage of the planning process, you may also need to complete CIL Forms 2–14. Please refer to the information below to determine which forms are required

Form 2: Assumption of Liability

Once planning permission is granted, we will issue a Liability Notice. This notice will detail the CIL charge, identify the liable parties, and explain the payment process.

To assume liability and/or apply for a CIL exemption, the applicant or liable party must complete Form 1. Submitting this form early in the planning process helps ensure that the Liability Notice is accurate.

If a party wishes to withdraw or transfer liability, they must submit Form 3 or Form 4 (see below). A Revised Liability Notice will then be issued to reflect any changes.

Please note: If no one has assumed liability before development begins, a £50 surcharge per liable party will apply.

Forms 3 and 4: Withdrawing or Transferring Assumed Liability

If a liable party needs to withdraw or transfer their liability at any stage during the application process, they must complete either Form 3: Withdrawal of Assumption of Liability or Form 4: Transfer of Liability.

Liability can be transferred at any time up to the day before the final payment is due.

Form 5 : Notice of Chargeable Development

This form should be used by landowners to inform us of their intention to commence development that does not require planning permission but may still be liable for the Community Infrastructure Levy (CIL).

CIL charges can apply to developments permitted under a General Permitted Development Order, Local Development Order, Neighbourhood Development Order, or a Community Right to Build Order. We may also issue a Notice of Chargeable Development if we determine that a CIL-liable development has taken place.

Form 6 : Commencement Notice

A Commencement Notice must be submitted at least one day before development begins on site. Once received, we will issue a Demand Notice to all liable parties, setting out the CIL amount due.

Failure to submit a Commencement Notice will result in a surcharge of 20% of the chargeable amount or £2,500, whichever is lower.

Form 7: Self Build Exemption Claim (Part 1 and 2)

•    Form 7: Self Build Exemption Claim Part 2 (Must be submitted with six months of completion of building work in order for the exemption to be valid)

Please complete and submit Forms 7 (parts 1 and 2) if you wish to claim an exemption for building a new dwelling. In order to qualify for a self-build exemption your development must meet certain criteria. This can be found on the Government website.

Form 8: Residential Annex Exemption Claim

Please complete and submit Form 8 if you wish to claim an exemption from CIL for building a residential annex.

Form 9 : Residential Extension Exemption Claim

Please complete and submit Form 9 if you wish to claim an exemption from CIL for building an extension to your home.

Form 10: Claiming Charitable and/or Social Housing Relief

Please complete and submit Form 10 if you wish to claim charitable and/or social housing relief for CIL. 

Form 11: Claiming Exceptional Circumstances Relief

Please complete and submit Form 11 if you wish to claim exceptional circumstances relief from CIL.

Form 12: Further Charitable Social Housing Relief

Please complete and submit Form 12 if your development was previously granted charitable or social housing relief, has since been amended under a Section 73 permission, and you wish to claim additional charitable or social housing relief from CIL.

Form 13: Claiming Further Exemption for Self-Build, Residential Annex or Residential Extension

Please complete and submit Form 13 if your development was previously granted an exemption from CIL for self-build, residential annex, or residential extension, has been amended by a Section 73 permission, and you wish to claim further exemption from CIL.

Form 14: Application for a Phase Credit

If you have assumed CIL liability for a phase of a development where planning permission was granted prior to the implementation of Welwyn Hatfield Borough Council’s Charging Schedule on 1 October 2025, but a subsequent phase of the development is now liable for CIL and you wish to offset the CIL liability, you can apply for a ‘phase credit’ by completing and submitting Form 14.
