Disagreeing with a Fixed Penalty Notice and making a representation
There are no formal grounds of appeal against a Fixed Penalty Notice. This is because a Fixed Penalty Notice is an invitation for you to discharge your liability to prosecution.
This means that if you agree that an offence has been committed and you pay the Fixed Penalty Notice, no further action in the form of prosecution for the offence will be taken by the council.
This approach saves time for everyone (including the offender) by not prosecuting cases at court and also a Fixed Penalty Notice fee is likely to be much lower than a fine imposed by the courts.
If you choose not to pay, we will start court proceedings. This could result in a fine of up to £5000 for some offences and unlimited fines for others.
If you do not agree that you committed the offence:
- you can make a representation to our partners Kingdom
- it will then be dealt with through formal prosecution via the courts
- the court will recieve evidence and determine whether an offence was committed and if any penalty should be paid.
It is important to be aware that the financial penalty imposed by the Courts can be significantly greater than a Fixed Penalty Notice.
